Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using Fungify ("the App"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not download, install, or use the App.

These Terms constitute a legally binding agreement between you and Fungify. We may update these Terms from time to time, and your continued use of the App after such changes constitutes acceptance of the updated Terms.

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Fungify on your personal mobile device for your personal, non-commercial use.

This license does not include the right to:

Modify, adapt, alter, translate, or create derivative works of the App
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
Remove, alter, or obscure any copyright, trademark, or other proprietary notices
Rent, lease, lend, sell, sublicense, or otherwise transfer the App to any third party
Use the App for any commercial purpose without our express written consent
Use the App in any way that violates applicable laws or regulations

3. User Accounts and Registration

To use certain features of Fungify, you may be required to create an account. You can register using:

Google Sign-In
Apple Sign-In

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

Provide accurate, current, and complete information when creating an account
Maintain and update your account information to keep it accurate
Notify us immediately of any unauthorized use of your account
Accept responsibility for all activities that occur under your account

4. User Content

You retain ownership of any content you create, upload, or share through Fungify ("User Content"), including but not limited to:

Photos of mushrooms and foraging locations
Route data and location information
Notes, descriptions, and other text content
Profile information

By using our service, you grant us a worldwide, non-exclusive, royalty-free license to store, display, and share your content as you direct through the app's sharing features. This license terminates when you delete the content or your account, except to the extent we need to retain it for legal purposes.

You represent and warrant that:

You own or have the necessary rights to all User Content you upload
Your User Content does not infringe on any third-party rights (including intellectual property, privacy, or publicity rights)
Your User Content complies with all applicable laws and regulations
Your User Content does not contain harmful, offensive, or illegal material

5. Permissions and Device Access

Fungify requires certain permissions to function properly:

Location Services

The App requires location permissions to:

Display your position on maps
Record and track mushroom foraging routes
Tag locations where you find mushrooms
Enable background location tracking for route recording (when enabled)

You can control location permissions through your device settings. Background location tracking is optional and can be disabled at any time.

Camera and Photo Library

The App requires camera and photo library access to:

Take photos of mushrooms and locations
Select and upload existing photos from your library
Save photos taken within the app to your device

Biometric Authentication

If you choose to use Face ID or other biometric authentication, this data is stored securely on your device and is never transmitted to our servers.

Notifications

The App may send you push notifications for app updates, route tracking status, and other app-related information. You can manage notification preferences through your device settings.

Analytics and Tracking

The App uses analytics services (Firebase and Vexo) to collect anonymous usage data. You can opt out of tracking through your device settings in accordance with Apple's App Tracking Transparency framework and Google Play's data safety requirements.

6. Safety and Responsibility

CRITICAL WARNING: Fungify is a documentation tool and should not be used as a guide for mushroom identification or consumption. Always consult with a qualified mycologist before consuming any wild mushrooms. We are not responsible for any harm that may result from the use or misuse of information shared through our platform.

You are solely responsible for:

Proper identification of mushrooms before consumption
Following local laws and regulations regarding foraging
Respecting private property and obtaining necessary permissions
Practicing sustainable foraging methods

7. Privacy

Your privacy is important to us. We collect and use your data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. Location data and personal information are stored securely and only shared as you explicitly choose through the app's sharing features.

By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

8. Prohibited Uses

You agree not to use the App:

In any way that violates any applicable law or regulation
To infringe upon or violate our intellectual property rights or the intellectual property rights of others
To transmit any malicious code, viruses, or harmful data
To engage in any automated use of the system (scraping, data mining, etc.)
To interfere with or disrupt the App or servers connected to the App
To impersonate or attempt to impersonate another user or person
To collect or store personal data about other users without their consent
To use the App for any commercial purpose without our express written consent

9. Disclaimer

The materials on Fungify are provided on an 'as is' basis. Fungify makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

10. Limitations of Liability

In no event shall Fungify or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Fungify, even if Fungify or a Fungify authorized representative has been notified orally or in writing of the possibility of such damage.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fungify and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Your User Content

12. Revisions and Errata

The materials appearing on Fungify could include technical, typographical, or photographic errors. Fungify does not warrant that any of the materials on its platform are accurate, complete, or current. Fungify may make changes to the materials contained on its platform at any time without notice.

13. Account Termination

You may terminate your account at any time by deleting the App or contacting us through the app's support features.

We reserve the right to terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination:

Your right to use the App will immediately cease
We may delete your account and User Content
All provisions of these Terms that by their nature should survive termination will survive

14. Third-Party Services

The App may integrate with or link to third-party services, including:

Google Sign-In and Google Maps
Apple Sign-In
Supabase (database and authentication)
Firebase and Vexo (analytics)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

15. Intellectual Property

The App and its original content, features, and functionality are owned by Fungify and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The Fungify name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Fungify or its affiliates.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization], except where prohibited by law.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fungify regarding the use of the App and supersede all prior agreements and understandings.
